The court termed the state government’s decision. In this petition, the petitioners contended that the government order issued on 9 September 2024 violated eligibility standards by raising the requirements for the two-year D.El.Ed course from Intermediate to Graduation. They argued that the eligibility for the D.El.Ed (Special Course), which trains teachers for disabled children, remains at Intermediate only. This order discriminates against certain categories of candidates who want to apply for admission to the DELED program because the eligibility for its special course.

The government of the Utter Pradesh argues that this is one of its policy decisions for UP DELED 12TH students

The government argued that it has the right to set a qualification higher than the one set by NCTE. This decision stems from its policy, which is not subject to judicial review unless the order is unconstitutional. The court stated that private institutions should require an Intermediate qualification for this course. The qualifications that the government established for D.El.Ed. differ from those it set for D.El.Ed. Introducing special courses would create a class within a class.
